The status of Regulation 206

A new emergency regulation was adopted on August 13th by DFS Acting Superintendent Albanese.

Simply put, the original emergency regulations (including the new Regulation 206) remain in effect.

It is our understanding that the DFS has a new proposal awaiting approval by the Governor’s Office but the emergency regulations will stay in place until that occurs.

DFS Emergency Regulation 206 extended to Aug 13

Published in the State Register July 1 2015, emergency regulation 206 has been extended 45 another 45 days.

 

The State Administrative Procedures Act (SAPA) allows a regulation to be renewed on an emergency basis for one year. Regulation 206 was first adopted September 27, 2014.

  

Individuals and business entities subject to regulation should be mindful that an emergency regulation has the full force and authority law.

New item in the Reg 208 TOOLKIT

NY State Senator Murphy wrote a letter to DFS Superintendent Lawsky about regulation 208. It points out important issues and possible direction for the coming weeks and months.

Ancillary Services and Inducements

The title industry was surprised by the proposed regulation 208 last week.  Left unchecked, this unworkable regulation would create unnecessary and unanticipated consequence while failing to bring about its purported objective of driving costs out of the system and resulting in lower premiums for consumers.

 

The Executive Committee is meeting on May 12th to discuss our response and approve a strategy for the 45-day comment period that ends June 22nd.

 

When faced with a threat to one's livelihood, an emotional reaction is natural and understandable. However, a successful strategy must be based on reason and calculation.  The process starts with being informed and understanding the governmental process.
