Title Insurance RFP - Deadline April 15, 2024

The Nassau County Industrial Development Agency (the “Agency”) seeks qualified title insurers, title abstract firms and other qualified firms and/or persons to conduct title searches, cause the issuance of title insurance policies (either directly or as authorized agents for title insurers), perform other title insurance-related services with respect to proposed “projects” of the Agency, and perform related professional services, at the direction of the Agency as more particularly described here (see attached document).

Nassau County Clerk - Office Procedures as of April 13, 2020

In an effort to protect our staff and the residents we serve, the Nassau County Clerk’s Office is closed for in person access. We continue to operate with very limited staff in accordance with the Governor’s orders. Documents are processed in the order they are received. Please use the following procedures to utilize the services of our office.

 

**While New York State has delayed the opening of the SCAR filing period, petition forms are still available on the County Clerk’s website to print and prepare at home. Please do not send SCAR filings to the County Clerk’s office until the courts have resumed full operations and a SCAR filing period has been announced.**

 

Land Records
• Document recordings can be submitted through e-recording, mail/delivery or lobby drop box
• Online records are available at:

• Document requests can be mailed/delivered or placed in lobby drop box

 

Court Records
• Per the Courts Administrative Order only matters deemed essential are being accepted. The Order can be found at: https://www.nycourts.gov/whatsnew/pdf/AO-78-2020.pdf
• SCAR proceedings are not considered essential by the courts and therefore SCAR applications will not be accepted until further notice
• Document filings only pertaining to essential matters can be submitted through NYSCEF e-filing, mail/delivery or lobby drop box

• Document requests can be mailed/delivered or placed in lobby drop box

Important for those of you asking questions about whether vendors, lawyers or other third parties who service financial institutions are essential, the follow is included in the guidance at question 11:

 

QUESTION: What if my business is NOT an “Essential Business” listed on ESD’s guidance but provides services, materials, supplies or other support to an Essential Business?

 

ANSWER: If your firm is a vendor, supplier or provides other support to an Essential Business that is required for the Essential Business’s operation, then your business is exempt from the employment reduction provisions contained in Executive Orders 202.8. However, only those employees necessary to support the Essential Business are exempt from the employment reduction requirements of Executive Orders 202.8 and your business is still required to utilize telecommuting or work from home procedures to the maximum extent possible.

Long Island Town Hall Rescheduled

Nassau County Disputed Assessment Fund

Nassau will begin informing 14,000 area business owners this week of a new state law that officials say will result in tax hikes for all commercial properties but will end the county’s need to borrow about $80 million annually for commercial property tax refunds.

 

The law, which was passed by the state legislature in 2014 and goes into effect with the 2016/17 tax roll, requires business owners who contest their assessments to place up to 10 percent of the assessed value of their property in an escrow account. Funds from that account will be used to pay commercial property tax refunds if the business wins its challenge.

 

County Executive Edward Mangano said the Disputed Assessment Fund would create “incentives” for commercial businesses to quickly resolve their property tax claims.

 

“Practically speaking, they are not harmed,” Mangano says of the commercial property owner. “If they are correct they will pay their fair share of taxes ... and they will get their money back rapidly.”

 

To compensate for the money held in escrow, all commercial properties would see a tax rate increase, officials said.

 

Donald Leistman, head of the tax challenge division of the Nassau County Bar Association, said businesses will have “sticker shock” when they see their bills.

 

“The burden is shifting from the county as a whole to solely on the commercial property owners,” Leistman said.

 

For decades, Nassau paid out about $100 million annually for residential and commercial property tax refunds, Mangano said.

 

In 2011, Mangano instituted a residential settlement program to decide challenges before tax bills are issued. The program largely eliminated residential refunds, which averaged between $20 and $30 million per year, county officials said.

 

The new commercial program, Mangano said, would “significantly” reduce the county’s remaining liability.

If the court were to grant a commercial business owner a property tax refund exceeding 10 percent, Nassau would pay that additional amount from its operating budget, Mangano said.

 

The deadline for filing tax protests for the 2016/17 tax roll is May 2. Commercial property owners have until July 22 to reach a settlement with the Department of Assessment before the county imposes its escrow charge.

 

The county can grant assessment reductions while challenges continue. In rare circumstances, such as when a property has significant environmental problems, the amount in escrow could exceed 10 percent, Mangano said.

 

That assessment roll would be used by schools, towns and other taxing jurisdictions to set tax rates. School tax bills go out in October and county, town and general tax bills go out in January.

 

At that point, the county will bill commercial property owners for the difference in taxes calculated by using the old disputed assessment multiplied by the new tax rates.

 

That money will be put in escrow. If the property owner wins an assessment reduction, the escrow fund will be tapped to pay the refund. If the business owner loses, the money paid into the fund would go to the taxing districts.

Happy News from Nassau County

The Honorable Maureen O'Connell, Nassau County Clerk has informed us:

 

"... the Clerk's online database via US Land Records now gives access to uncertified images of all land documents in our database, free of charge.  This should alleviate stress and overcrowding in our search area

... Not only can a computer in an office or home now search for everything in the County Clerk land database, but the cost for doing so would be identical as doing the search in the Clerk’s office....

 

Also, ...  please include a reminder about the Assessment TMV letter not necessarily having an SBL that is consistent with the official County Clerk SBL.  This inconsistency is leading to submitters changing the SBL on instruments to match the Assessment letter (not the County Clerks) and creates rejections before the submission even reaches our internal system."

The Nassau TMVL is not your friend

Amazing stuff you can find out if you just ask.  

 

Last week, the Nassau County Clerk told me that the section/block/lot on the Assessor’s Tax Map Verification Letter is often incorrect. So if you are recording documents with Nassau County, use the S/B/L from the legal description. Do not use the S/B/L from that $225 letter you just bought.


According to the County Clerk, the maps used by the Assessor do not agree with the maps used by the Clerk.

 

As my grandmother used to say, “Who knew?”

Nassau County Legislature passes emergency resolutions

On the evening of Monday, December 21, 2015 the Nassau County Legislature passed two emergency resolutions. This vote changed to January 4, 2016, the effective date of the block recording fee increase and the Tax Map Verification Letter (TMVL) fee increase.

 

These are recorded as Resolution 542-15 and 543-15 and the files are attached to this blog post.

The Association's public comment starts at 05:01:00 and lasts for about 5 minutes.

  

The vote of the Legislature starts at approximately 07:23:00.

  

The logistics of the refunds have not yet been announced.  We will post that information here as soon as possible.

 

Earlier today, we spoke with Nassau County Clerk O'Connell, who was a very vocal opponent to these fee increases.  The Clerk's Office has provided the following information:


-          There is a grace period for the new fee.  All documents presented for recording prior to 9 am January 4, 2016 will be subject to the current block fee ($150).


-          This means the last day to present instruments for recording in person for the current fee ($150) will be December 31, 2015 as Friday January 1, 2016 is a County holiday.


-          Please ensure all documents presented by your on-site recorders have been thoroughly reviewed for recordability.


-          Documents presented prior to the end of the grace period (1/4/16) that are rejected and resubmitted after January 4, 2016 will be subject to the new block fee ($300) regardless of when the document was initially presented.

 

On a personal note, I want to say that I had to sit in the Legislature's Chamber for six hours to have my three minutes to speak. NYSLTA Member and Nassau County Legislator Howard Kopel has been on the right side of this issue from the start and we are grateful for all his help. I appreciate the company of NYSLTA President Marianne Mathieu, who provided the moral support this endeavor required.  Also, I enjoyed the company of NYSLTA Members Sal Turano and Ted Werner.

 

The material benefits of this resolution, as measured in dollars is modest. The meaning of the accomplishment is much more important. The title industry spoke with one voice and we were heard.  The unsung helpers at Title Action Network, as well as Paul Larrabee and Scott Wexler made immeasurable contributions.

  

If you are an NYSLTA Member, you should be proud of your profession and the vital role you play in the functioning of the real estate economy.

Orange County announces web site subscription fees

Effective January 1, 2016 there will be a subscription fee to access the Orange County Land Records website.

Fees are as follows:

    Unlimited access {view only) $150.00 per quarter in State subscribers.
    Unlimited access {view only) $600.00 per quarter out of State subscribers.
    Copies are an additional per page fee of .65 cents payable by credit card.
    Non subscriber timed access $15.00 for fifteen minutes.

Initial account must be established by check, renewals can be payable by credit card. Cancellation can be done anytime by notifying IQS, however any unused portion is nonrefundable. Service will commence once payment is received.

Nassau County Fee increases

On Monday December 21, the Nassau County Legislature is in public session starting at 1 PM. (Click for details)

We are planning to present public comment at that session to address the recent fee increases which took effect on December 7th.

When do fee increases in Nassau County take effect

UPDATE 11AM - THURSDAY DEC 3- 2015 

 

The Nassau County Clerk's Office has confirmed the block fee increase will be effective Monday, December 7 and the payment system will be updated to accept the new fee.

   

Calls to the County Assessment Office have not been returned but we are informed the increased tax map fee will be posted on the County web site as Local Law 9.

As we have been reporting, Section 19-17.0 of the Nassau County Administrative Code has been amended to increase recording fees from $150 to $300. In separate legislation, the Tax Map Verification Letter fee will increase from $75 to $225.

 

These laws were delivered to the Department of State today.

 

Our contacts in Albany inform me that the law will take effect "immediately" on being read-in by the Secretary of State.
