Nassau County Clerk - Office Procedures as of April 13, 2020

The following bulletin has been issued by the Office of the Nassau County Clerk.  Please read in its entirety, as certain part concern examining and recording land records.

In an effort to protect our staff and the residents we serve, the Nassau County Clerk’s Office is closed for in person access. We continue to operate with very limited staff in accordance with the Governor’s orders. Documents are processed in the order they are received. Please use the following procedures to utilize the services of our office.

 

**While New York State has delayed the opening of the SCAR filing period, petition forms are still available on the County Clerk’s website to print and prepare at home. Please do not send SCAR filings to the County Clerk’s office until the courts have resumed full operations and a SCAR filing period has been announced.**

 

Land Records
• Document recordings can be submitted through e-recording, mail/delivery or lobby drop box
• Online records are available at:
https://i2f.uslandrecords.com/NY/Nassau/D/Default.aspx
• Document requests can be mailed/delivered or placed in lobby drop box

 

Court Records
• Per the Courts Administrative Order only matters deemed essential are being accepted. The Order can be found at: https://www.nycourts.gov/whatsnew/pdf/AO-78-2020.pdf
• SCAR proceedings are not considered essential by the courts and therefore SCAR applications will not be accepted until further notice
• Document filings only pertaining to essential matters can be submitted through NYSCEF e-filing, mail/delivery or lobby drop box
• Online records are available at: https://iapps.courts.state.ny.us/nyscef/HomePage
• Document requests can be mailed/delivered or placed in lobby drop box

Documents virtually notarized are being accepted during the Governor’s designated period. Inclusion of a certification page attesting to this is encouraged.


Passport Services are suspended. Please visit

All other County Clerk services will be provided where deemed essential.

The following is from a bulletin issued by Empire State Development


 

Important for those of you asking questions about whether vendors, lawyers or other third parties who service financial institutions are essential, the follow is included in the guidance at question 11:

 

QUESTION: What if my business is NOT an “Essential Business” listed on ESD’s guidance but provides services, materials, supplies or other support to an Essential Business?

 

ANSWER: If your firm is a vendor, supplier or provides other support to an Essential Business that is required for the Essential Business’s operation, then your business is exempt from the employment reduction provisions contained in Executive Orders 202.8. However, only those employees necessary to support the Essential Business are exempt from the employment reduction requirements of Executive Orders 202.8 and your business is still required to utilize telecommuting or work from home procedures to the maximum extent possible.

Please be advised, effective Tuesday, March 24, 2020, the Office of the Nassau County Clerk will continue to be closed to the public.  E-recording and E-filing will be processed with very limited staff levels.

Service Announcement from Suffolk County

We received the following update from Chris Como, Official Examiner of Title, Suffolk County Clerk's Office.

 

In accordance with directives from the Governor and County Executive, staffing at the County Clerk’s Office will be extremely limited in the upcoming weeks until further notice.

 

It is advised that all documents required to be recorded or filed be sent in via a trackable mail service as drop off availability in the lobby may be ending shortly without notice.

 

We are currently working on making printing available to those accessing our office remotely and have accounts within the next 48 hours.  Accounts can be credited by mailing in checks to the County Clerk’s Office (attention Public Access).  We also anticipate you will have the ability credit your accounts using credit cards once the printing function is available.   A separate e-mail will be sent once this is available.

 

While we are absorbing the licensing fees that permit off site access to our records, the County Clerk does not have the authority to waive any fee set by statute.  We will gladly comply with any State law or order directing these fees be waived.

 

For those seeking copies of previously recorded/filed documents or maps not available via remote access, they may purchased by using the attached form submitted to recordrequest@suffolkcountyny.gov.  Requests may also be made by mail using the same form.

 

Questions regarding filings/recording that are strictly of an immediate nature should be make directly to the appropriate department (see website for more info).

 

We are continuing to do our best with the limited resources to provide as much access to our records and staff as possible.  Since circumstances and government mandates are changing by the hour, any and all current practices are subject to change with no or very limited notification.  We will do our best to keep you informed as we have additional information. Please continue to check our website for updates as well.

Out of an abundance of caution, the internal lobby area of Village Hall at the Regatta (123 Mamaroneck Avenue) will be inaccessible to the public until further notice. Residents and members of the public seeking to do business at Village Hall may enter the vestibule area of Village Hall and approach the glass window where Village personnel can answer questions and process transactions. Please note that the public computer (which is located inside the internal lobby area) and used to check taxes and tax liens is unavailable at this time. Instead, individuals and employees of tax lien service companies should email their requests to clerktreasurer@vomny.org with the following information

Suffolk County Fee Decrease (yes- you read that right)

RE: Decrease on Mortgage Verification Fee

 

Please be advised that Local Law 19-2019 has provided for a decrease in the Real Property Tax Service Agency Mortgage Verification Fee from $300.00 to $200.00 for each mortgage related document verified and recorded.

 

The standard $200.00 per lot Real Property Tax Service Agency Verification fee for all recorded documents remains unchanged.


Effective immediately, all mortgage related documents presented for recording shall be assessed the new Real Property Tax Service Agency Mortgage Verification Fee of $200.00.

The proposed DFS regulations have the potential to turn the title industry upside down.  But together, we can do something about it.

Scroll down to see what the NYSLTA is doing to provide you with the tools and opportunities that will keep the people and companies in the title insurance business a vital part of the real estate finance economy in New York State.

Ring the alarm. Put out the fire.

It is not enough to complain and bring grievances to light. No one knows title insurance better than we do and every time we talk about the problems in these regulations, we will be asked, "What do you want to do about it?"

A vigorous discussion is going on the title industry and the Association is working on releasing a statement that meets the needs of underwriters, agents, abstractrers, attorneys, closers and consumers.

Get off your seat.

We are asking our Members to take the lead and we invite all title professionals to join us in taking action.

First - Sign up for lobby day.  The linked page will explain about meeting in your legislators' local office, how we will schedule the meeting for you and prepare you with Talking Points.  This is super important.

And if are not a member of the Title Action Network (TAN) you should sign up today.

Next - If you can possibly make it, attend the Town Hall meeting on Long Island at 10 AM on June 7. This event is free to everyone but we ask that you pre-register.  We are also planning a live webcast Town Hall later in June.

Best - Attend the annul meeting and convention in Syracuse August 20-23. We have more that unites us than opposition to wrong-headed regulations.  Meet with your peers, build your network and learn how to make your business stronger.

Long Island Town Hall Rescheduled

The Town Hall meeting on Long Island that was cancelled due to a snow storm has been rescheduled.

 

The event will take place at 10 AM on Wednesday April 26 at the Holiday Inn in Westbury.
