Priority 3 Bills signed Into Law

The following bills were signed into law by Governor Hochul in the final weeks of 2022.

 

The Legislative Committee categorizes bills introduced during the legislative session. Priority 3 bills are not critical issues but may be important changes to title insurance related practices or for people running a small business.

 

A3714 / S5097A (Requires the disclosure of indoor mold history upon the sale of certain real property.)

 

A5337A / S9470 (Authorizes special proceedings to convey title to abandoned commercial and industrial property to a city, town, or village.)

 

A7595 / S6805 (Requires copies of certain documents physically posted in a workplace to be made available to employees electronically through the employer's website or by email.)

 

A7737B/ S5473D (Relates to the rights of parties involved in foreclosure actions; provides additional details regarding the commencement and termination of certain actions related to real property.)

 

A10477 / S9427A (Requires employers to disclose compensation or range of compensation to applicants and employees upon issuing an employment opportunity for internal or public viewing or upon employee request.)

POA Bill signed by Governor

S9209/A10234 Signed by Governor

 

Minor Technical correction to clarify that powers of attorney need only to have been executed by the principal and conform to the law in effect at the time executed by such principal to remain valid and enforceable under the new law, even if signed by the agents at a later date.

Relates to complaints served in a proceeding initiated on a residential mortgage covering a one to four family dwelling. (RPAP L. mortgage foreclosures)

 

S7797 / A8725

Defines the term property/casualty insurance and provides for the electronic delivery of a policy notice or document by an insurer to a party who consents to such delivery.

Family Leave bill signed by Gov. Hochul

The amended Family Leave (S2928-A) bill now includes siblings.

 

In March 2021, the Legislative Committee reviewed the bill and made the following comment:

 

"... passage of this bill would not uniquely affect the title industry however, it is worth noting that NYS family leave is up to 12 weeks of paid time off work. Expanding eligibility may negatively impact small businesses including title agents.

It pertains to the Family Leave Act and expands the definition of family member for the purposes of paid family leave to include siblings."

Extends the limitations on the shift between classes of taxable property in the town of Orangetown, county of Rockland

Makes the affirmative allegation provisions for high-cost loans and subprime home loans applicable to foreclosures of residential mortgages covering one to four family dwellings.

APPROVAL MEMORANDUM - No- 16 Chapter 395

MEMORANDUM filed with Senate Bill Number 5785-A, entitled:

 

"AN ACT to amend the real property actions and proceedings law, in relation to foreclosure of residential mortgages covering one to four family dwellings"

 

APPROVED

 

This bill would amend the Real Property Actions and Proceedings Law to expand certain pleading requirements and defenses available in foreclo­ sure actions involving high-cost and subprime home loans, as those terms are defined in sections 6-1 and 6-m of the Banking Law respectively, to all foreclosure actions involving mortgages on residential one-to-four family homes.

 

It is important to provide homeowners with a full and fair opportunity to defend themselves in a foreclosure proceeding. While I agree with the sponsors' intent in that regard, this bill contains technical flaws that prevent its effective implementation _

 

Therefore, the Executive has secured an agreement with the Legislature to pass legislation in the upcoming session that would clarify the requirement for foreclosure actions involving all residential mortgage loans to plead compliance with the requirements of section 595-a of the Banking Law, and a clarification to avoid confusion about the applica­ tion of sections 6-1 and 6-m of the Banking Law. on that basis, I am signing this bill.
