Everything is OK in Nassau County

A senior staff member of Nassau County Clerk O'Connell called at 9 AM Saturday morning to respond to the previous blog posted here on Friday. 

 

As this was a weekend phone call - I cannot get the following report fact-checked by the Clerk's office until next week.

 

This report is from my notes of this morning's phone call. Any errors or misstatements will be corrected as soon as we are advised of them.

 

I explained my previous reports came from Examiners on site and were corroborated by Agents and an Direct operations Underwriter.

 

Well - it looks like the tech team from Xerox is not happy with us and they feel disparaged by the things said about the situation in Nassau county.  A blind man can see we are not popular with the Nassau County Clerk.

 

Here is what I learned on this morning's phone call:

 
1 - The new system (Xerox) is fully functional and the index can be accessed without charge from a bank of 20 computers on-site.  This went online at 11 AM Thursday

2 - The data in the Xerox system (1992-2015) is correct and reliable. He says there is no data gap July 1- Sept 30, 2015.  Any problem with gaps is due to training issues.

3 - The Xerox system can print specific pages. However he does admit that users must pay $2/page to view or download and unless one views an entire document, you can't know what page you want to print.

4 - A training packet was distributed last Thursday. A copy will be sent to me next week.

5 - 10 computers are available for public use to access the old system (Browntech). Three are connected to printers "behind the counter". The statutory fee they charge is 65-cents/page. 

6 - The Browntech system required Examiners to purchase payment cards for printing. These cards will be obsolete in a matter of days or weeks.

7 - The bottleneck is being caused by Examiners who are trying to "deplete the value" on their old Browntech cards and the 'Examiners do not trust the data in the new system.

I was told Clerk O'Connell does not want to make any statement until everything is up and running smoothly. I explained that it is when things are NOT running smoothly that people need to have information and an official statement. 

 

We disagreed on the better approach to communications  and crisis management. (They deny there is a crisis.)

I explained that the LTA has tried for years to establish formal communications with the Clerk's office and we have always been rebuffed.

 

I reiterated our offer to assist the Nassau County Clerk in disseminating information to the industry and facilitating the use of the Clerk's services.

 

Great efforts have been taken to acknowledge that these reports are based on 2nd hand information and we have made frequent requests to the Clerk's Office for comment. 

 

I appreciate the diligence of the gentleman who took personal time away from his family to call me.  Maybe there is hope we can build some bridges.

Nassau County - What we know now

On September 30, the Nassau County Clerk’s computerized real property index was scheduled for an upgrade and transition to an online system.  The change-over experienced massive failure, resulting in the disruption of examining records.

 

The Nassau County Clerk has not responded to multiple calls and emails requesting information and comment, as of 3:45 PM Oct 2, 2015.

.

Certain Underwriters have notified their agents that all closing transactions must be cleared by the legal department until further notice.

 

The following report is compiled from verbal accounts provided by examiners and agents familiar with the situation. 

 

THE FOLLOWING INFORMATION HAS NOT BEEN INDEPENDENTLY VERIFIED BY NYSLTA.

 

As part of the conversion, eight computers were removed from the public computer bank.

 

On Thursday Oct 1 , three print-capable computers were available to the public to access the old system.  Examiners were restricted to a 15 minute session.

 

On Friday, October 2, four more computers were added to view the old system but these newly added machines were not connected to printers.

 

Access to the old system is to be maintained until the new system is fully functional.

 

The Clerk has announced no plans to computerize records prior to 1992.

 

The new system is designed to cover 1992-current date. It was discovered that data from July 1 – September 30, 2015 was not found. On-site techs stated this should be fixed by next week.

 

The new system was also found to have gaps and omissions on the data prior to July 1, 2015, making this system unreliable.

 

Examiners in Mineola reported the technicians were helpful and professional, talking to Examiners and taking note of problems.

 

When the new system is operational it will be accessed online without a fee, however it will provide recording information such as page count and dates. To get document images, users download the document in its entirely at the rate of $2/page.

 

This report will be updated as information is available.

Nassau County is broken

The situation at the Nassau County Clerk's Office is dire.

A new computer system for records 1992 - present was scheduled to go live today and there are widespread failures.
The following information is NOT CONFIRMED but comes from trusted sources.

Three computers dedicated to the legacy system are not operating. These are intended to serve the pre-1992 era.
Contins are most immediately impacted. 

Examiners cannot access the most recent 90 days of data (7/1 - 9/30/2015).

 

Examiners are limited to 1 hour sessions on in-house computer

There are delays in recordings - unclear if this is a technology or training issue.
The address to the new online system has not been released.

There  are only 2 copiers available onsite, copier costs are now 65-cents/page and there is a long line waiting to use the 2 machines.

 

Another update is planned for Monday October 5th. 

There is no statement from the Clerk when the systems will be functioning again.

Calls are coming into NYSLTA seeking action and response.

 

I have contacted the Communications Director at the County Executive's Office and left messages with the Assistant Clerk and the Counsel at the County Clerk's Office.

 

I looking to escalate to a superior authority, reporting back to Association frequently when more information is available.
