The situation at the Nassau County Clerk's Office is dire.
A new computer system for records 1992 - present was scheduled to go live today and there are widespread failures.
The following information is NOT CONFIRMED but comes from trusted sources.
Three computers dedicated to the legacy system are not operating. These are intended to serve the pre-1992 era.
Contins are most immediately impacted.
Examiners cannot access the most recent 90 days of data (7/1 - 9/30/2015).
Examiners are limited to 1 hour sessions on in-house computer
There are delays in recordings - unclear if this is a technology or training issue.
The address to the new online system has not been released.
There are only 2 copiers available onsite, copier costs are now 65-cents/page and there is a long line waiting to use the 2 machines.
Another update is planned for Monday October 5th.
There is no statement from the Clerk when the systems will be functioning again.
Calls are coming into NYSLTA seeking action and response.
I have contacted the Communications Director at the County Executive's Office and left messages with the Assistant Clerk and the Counsel at the County Clerk's Office.
I looking to escalate to a superior authority, reporting back to Association frequently when more information is available.
Members are encouraged to comment with additional information, questions or concerns.

Continuing Education, also know as CE, is a fact of life for physicians, CPAs, Financial Planners, and virtually every licensed professional. However, CE is new to title agents in New York State.
Many of us are very familiar with CLE, the continuing legal education required for attorneys and you may think CE is similar to CLE. But you would be wrong.
The DFS has been managing continuing education for health & medical, property & casualty insurance agents for years and that is the system title agents now must conform to.
The DFS has provided CE information for agents here:

This is what you need to remember:
- You need 15 CE credits to renew your license
- The Provider, Instructor and Course must be approved by the DFS
- When you complete a course, the Provider will report your credits and license number to DFS
- The DFS will apply the credits to every license registered to that exact name.
- The Provider will also give you a certificate. Keep the certificate in the event all the credits you earned are not reported at the time of license renewal.
One more thing - the NYSLTA is building a catalog of CE courses to be offered and taken online. However online courses require an exam before credit can be issued.
The Education Committee is also going to offer the popular CORE TITLE SERVICE courses in 2016. But that is another story.

A new emergency regulation was adopted on August 13th by DFS Acting Superintendent Albanese.

Simply put, the original emergency regulations (including the new Regulation 206) remain in effect.
It is our understanding that the DFS has a new proposal awaiting approval by the Governor’s Office but the emergency regulations will stay in place until that occurs.

NYSLTA issued a news release today announcing the election of the 2015-2016 Officers. Click the attached file to see the complete news release.

We held our annual meeting last week and a very significant change in our By-laws was approved by both the Title Insurance Section and the Agents Section in their respective Section Meetings.
It concerns the Executive Committee voting requirements to approve a motion. In simple terms, a two-thirds majority of the EC Members present in person or by proxy decides the outcome of a vote. There are exceptions for issues which raise anti-trust concerns but that's it in a nutshell.
This is a significant step towards parity between the Sections. The Title Insurance Section voted to relinquish their ability to defeat a motion with only a handful of Title Section votes, a power not available to the Agents Section.
The Underwriters and the Agents bring different things to the title insurance marketplace and there is no denying the split is a "zero-sum game". Neither can we ignore the competitive tensions within each section. That's Ok. You knew this when you got into this business.
As the Association Executive Director, I have the advantage of stepping back from the daily fray of commerce and from this perspective I see good things happening.
The change in the voting structure is a sign of this Association's maturity and growth toward speaking with one voice in the common interests of the title industry.

Important Lessons From Monkeys
You start with a cage containing four monkeys, and inside the cage you hang a banana on a string, and then you place a set of stairs under the banana.
Before long a monkey will go to the stairs and climb toward the banana.
You then spray ALL the monkeys with cold water.
After a while, another monkey makes an attempt. As soon as he touches the stairs, you spray ALL the monkeys with cold water.
Pretty soon, when another monkey tries to climb the stairs, the other monkeys will try to prevent it.
Now, put away the cold water.
Remove one monkey from the cage and replace it with a new monkey.
The new monkey sees the banana and attempts to climb the stairs. To his shock, ALL of the other monkeys beat the crap out of him.
After another attempt and attack, he knows that if he tries to climb the stairs he will be assaulted.
Next, remove another of the original four monkeys, replacing it with a new monkey.
The newcomer goes to the stairs and is attacked.
The previous newcomer takes part in the punishment – with enthusiasm -- because he is now part of the "team.”
Then, replace a third original monkey with a new monkey, followed by the fourth.
Every time the newest monkey takes to the stairs, he is attacked.
Now, the monkeys that are beating him up have no idea why they were not permitted to climb the stairs. Neither do they know why they are participating in the beating of the newest monkey.
Having replaced all of the original monkeys, none of the remaining monkeys will have ever been sprayed with cold water.
Nevertheless, not one of the monkeys will try to climb the stairway for the banana.
Why, you ask? Because in their minds, that is the way it has always been!

Changes to the TIRSA Rate Manual, section 14 and new sections 14A and 14B take effect August 1. The Refinance and Subordinate Mortgage section has been amended. Agents should contact their Underwriter for details on the rate changes and with any questions.
