Here is what you will not find in Nassau County this morning:
- Lis pendens are not indexed in the new system
- All three major eRecording companies are no longer accepting documents for Nassau County
- You won't find a County Clerk (or her staff)
I called the Clerk a few minutes ago. Understandably she and her entire staff are in a meeting. One hopes they are working to address these issues.
Members have called to say additional computers have been connect to the old system and there are computers running both systems to enable checking the completeness of the recorded data.
The eRecordng companies say they will resume eRecording in Nassau AFTER they have completed their independent testing of the system integrity.
It would be wrong to say Clerk O'Connell and her staff are doing nothing. I cannot believe they are happy about this and I am certain they want things fixed and running smoothly.
In my message, I requested additional staff be put on to accept walk-in recordings and I urged them to communicate the status on a regular basis. That would help diminish the fear and concern borne of uncertainty.
To Members - please note the Title Section is meeting to consider remedies. I will report on the progress of that initiative as best as I am able.
Members can add comments. Non-members can email comments for posting to rgt@nyslta.org AND rcapone@nyslta.org.

A senior staff member of Nassau County Clerk O'Connell called at 9 AM Saturday morning to respond to the previous blog posted here on Friday.
As this was a weekend phone call - I cannot get the following report fact-checked by the Clerk's office until next week.
This report is from my notes of this morning's phone call. Any errors or misstatements will be corrected as soon as we are advised of them.
I explained my previous reports came from Examiners on site and were corroborated by Agents and an Direct operations Underwriter.
Well - it looks like the tech team from Xerox is not happy with us and they feel disparaged by the things said about the situation in Nassau county. A blind man can see we are not popular with the Nassau County Clerk.
Here is what I learned on this morning's phone call:
1 - The new system (Xerox) is fully functional and the index can be accessed without charge from a bank of 20 computers on-site. This went online at 11 AM Thursday
2 - The data in the Xerox system (1992-2015) is correct and reliable. He says there is no data gap July 1- Sept 30, 2015. Any problem with gaps is due to training issues.
3 - The Xerox system can print specific pages. However he does admit that users must pay $2/page to view or download and unless one views an entire document, you can't know what page you want to print.
4 - A training packet was distributed last Thursday. A copy will be sent to me next week.
5 - 10 computers are available for public use to access the old system (Browntech). Three are connected to printers "behind the counter". The statutory fee they charge is 65-cents/page.
6 - The Browntech system required Examiners to purchase payment cards for printing. These cards will be obsolete in a matter of days or weeks.
7 - The bottleneck is being caused by Examiners who are trying to "deplete the value" on their old Browntech cards and the 'Examiners do not trust the data in the new system.
I was told Clerk O'Connell does not want to make any statement until everything is up and running smoothly. I explained that it is when things are NOT running smoothly that people need to have information and an official statement.
We disagreed on the better approach to communications and crisis management. (They deny there is a crisis.)
I explained that the LTA has tried for years to establish formal communications with the Clerk's office and we have always been rebuffed.
I reiterated our offer to assist the Nassau County Clerk in disseminating information to the industry and facilitating the use of the Clerk's services.
Great efforts have been taken to acknowledge that these reports are based on 2nd hand information and we have made frequent requests to the Clerk's Office for comment.
I appreciate the diligence of the gentleman who took personal time away from his family to call me. Maybe there is hope we can build some bridges.

On September 30, the Nassau County Clerk’s computerized real property index was scheduled for an upgrade and transition to an online system. The change-over experienced massive failure, resulting in the disruption of examining records.
The Nassau County Clerk has not responded to multiple calls and emails requesting information and comment, as of 3:45 PM Oct 2, 2015.
.
Certain Underwriters have notified their agents that all closing transactions must be cleared by the legal department until further notice.
The following report is compiled from verbal accounts provided by examiners and agents familiar with the situation.
THE FOLLOWING INFORMATION HAS NOT BEEN INDEPENDENTLY VERIFIED BY NYSLTA.
As part of the conversion, eight computers were removed from the public computer bank.
On Thursday Oct 1 , three print-capable computers were available to the public to access the old system. Examiners were restricted to a 15 minute session.
On Friday, October 2, four more computers were added to view the old system but these newly added machines were not connected to printers.
Access to the old system is to be maintained until the new system is fully functional.
The Clerk has announced no plans to computerize records prior to 1992.
The new system is designed to cover 1992-current date. It was discovered that data from July 1 – September 30, 2015 was not found. On-site techs stated this should be fixed by next week.
The new system was also found to have gaps and omissions on the data prior to July 1, 2015, making this system unreliable.
Examiners in Mineola reported the technicians were helpful and professional, talking to Examiners and taking note of problems.
When the new system is operational it will be accessed online without a fee, however it will provide recording information such as page count and dates. To get document images, users download the document in its entirely at the rate of $2/page.
This report will be updated as information is available.
NOTE – IF YOU HAVE FIRST HAND INFORMATION ABOUT THE SITUATION IN MINEOLA, PLEASE POST A COMMENT.
COMMENTS SHOULD HAVE A BASIS IN FACT AND NOT DISPARAGE ANY INDIVIDUAL OR ORGANIZATION.
KEEP IT CLASSY.

The situation at the Nassau County Clerk's Office is dire.
A new computer system for records 1992 - present was scheduled to go live today and there are widespread failures.
The following information is NOT CONFIRMED but comes from trusted sources.
Three computers dedicated to the legacy system are not operating. These are intended to serve the pre-1992 era.
Contins are most immediately impacted.
Examiners cannot access the most recent 90 days of data (7/1 - 9/30/2015).
Examiners are limited to 1 hour sessions on in-house computer
There are delays in recordings - unclear if this is a technology or training issue.
The address to the new online system has not been released.
There are only 2 copiers available onsite, copier costs are now 65-cents/page and there is a long line waiting to use the 2 machines.
Another update is planned for Monday October 5th.
There is no statement from the Clerk when the systems will be functioning again.
Calls are coming into NYSLTA seeking action and response.
I have contacted the Communications Director at the County Executive's Office and left messages with the Assistant Clerk and the Counsel at the County Clerk's Office.
I looking to escalate to a superior authority, reporting back to Association frequently when more information is available.
Members are encouraged to comment with additional information, questions or concerns.

If you are a licensee or sub-licensee looking for title agent CE - click here or use the top navigation on this page and click CALENDAR & EVENTS
Continuing Education, also know as CE, is a fact of life for physicians, CPAs, Financial Planners, and virtually every licensed professional. However, CE is new to title agents in New York State.
Many of us are very familiar with CLE, the continuing legal education required for attorneys and you may think CE is similar to CLE. But you would be wrong.
The DFS has been managing continuing education for health & medical, property & casualty insurance agents for years and that is the system title agents now must conform to.
The DFS has provided CE information for agents here:
http://www.dfs.ny.gov/insurance/abindx.htm
This is what you need to remember:
- You need 15 CE credits to renew your license
- The Provider, Instructor and Course must be approved by the DFS
- When you complete a course, the Provider will report your credits and license number to DFS
- The DFS will apply the credits to every license registered to that exact name.
- The Provider will also give you a certificate. Keep the certificate in the event all the credits you earned are not reported at the time of license renewal.
One more thing - the NYSLTA is building a catalog of CE courses to be offered and taken online. However online courses require an exam before credit can be issued.
The Education Committee is also going to offer the popular CORE TITLE SERVICE courses in 2016. But that is another story.

A new emergency regulation was adopted on August 13th by DFS Acting Superintendent Albanese.
Here’s a link: http://dfs.ny.gov/insurance/r_emergy/reconsol9t.pdf
Simply put, the original emergency regulations (including the new Regulation 206) remain in effect.
It is our understanding that the DFS has a new proposal awaiting approval by the Governor’s Office but the emergency regulations will stay in place until that occurs.

Our Annual Meetings are renown for the good fellowship and social amity that pervades the event. We also provide valuable professional information, which justifies the time away from the office.
I have been asked to provide two of the presentations for download and you will find them on this Members Web site.
Doug Duncan, Fannie Mae economist presented a dazzling array of data about the economy in general and the factors driving the housing market. Go to GOVERNMENT>FEDERAL using the top navigation or click this link: http://nyslta.site-ym.com/?page=GoveFederal and scroll down .
Bill Burding of Orange Coast Title and a Member of the ALTA Board of Governors gave us the latest on how ALTA is viewing and addressing the challenges of CFPB and TRID. Go to RESOURCES>COMPLIANCE SUPPORT or click this link: https://nyslta.site-ym.com/?page=Compliance
Both of these presentations have timely information, which means as the weeks and months roll on the accuracy will diminish. We intend to remove these links in a few months so if you need the slides and cannot download them, call the NYSLTAStaff at 212-964-3701.
